Stance 1St Birthday COMPETITION AUSTRALIA

1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

2. The Promoter is Accent Group Limited ABN 85 108 096 251, 2/64 Balmain Street, Cremorne, VIC 3121, Australia. Ph: 03 9427 9422.

3.Entry is open to all residents of Australia. However, employees and their immediate families of the Promoter and their associated agencies and companies are not eligible to enter.

4.The competition commences on 25th August at 09:00 (AEST) and concludes on 31st August 2021 at 23:59 (AEST) (Promotional Period). 

5.The competition will be advertised on Stance website and social channels.

6.To enter each draw, participants must:

i.Enter via the Stance website or sign up form. Input requested details including (but not limited to) a valid email address, first name and last name.

ii.Existing members can enter by completing the online competition form during the Promotional Period. The competition form link will be sent via email to users subscribed to Stance during the Promotional Period.

iii.Submit the fully completed form.

iv.Upon form submission the entrant will be automatically entered in the draw to win the respective Stance Prize.

7. Entry is only open to Australian residents who are 13 years and over. Entrants under the age of 18 must have parent or legal guardian approval to enter.
8.Incomplete entries will be deemed invalid.

9.Any entry that is made on behalf of an Entrant by a third party will be invalid.
10.Anyone found to use multiple accounts to enter will be considered ineligible. 

11.Entrants in the competition may only enter once per email address. Only one prize per household is permitted, with the exception of SA residents who, under State Legislation, are entitled to win more than one prize.  

12.The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of the Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or the Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

13.Entries must be received by 31st August 2021 at 23:59 (AEST). The time of entry will in each case be the time the online entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason. 

14.The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.

15.There will be a total of one (1) winner. 

16.No part of the prize is exchangeable, redeemable for cash or any other prize or transferable. 

17.Total prize value is up to AUD$420. The prize contains 1 years worth of Stance socks (total of twelve (12) socks picked by the Stance representative).

18.If the prize(s) is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.

19.Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.

20.By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.

21.In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with the Promoter or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.

22.If the competition winner is under 18 years of age, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner.

23.The draws will take place at Accent Group Limited, 2/64 Balmain Street, Cremorne, VIC 3121, Australia at 02:30 pm AEST on 2nd September 2021, using computerised random selection. The winners will be notified by email within 2 days of the draw. The Promoter reserves the right to publish the winners’ details on the Stance websites and social channels within 2 days of the draw.

24.Prizes will be awarded to the person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder).  

25.Should an entrant’s contact details change during the Promotional Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

26.Subject to any direction given under relevant State legislation, an unclaimed prize draw will take place at Accent Group Limited, 2/64 Balmain Street, Cremorne, VIC 3121, Australia at 02:30 pm AEST 6th September 2021, using computerised random selection. The winners will be notified within 2 days of the draw. The winners will be notified of their prize by email and the Promoter reserves the right to published their details on the Stance websites and social pages within 2 days of the draw.

27.The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the competition result.

28.In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.

29.The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

30.The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

31.The Promoter and its associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

32.All entries become the property of the Promoter. All opt-in entries will be entered into a database and The Promoter may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact the Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to the Promoter.

33.Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.

Offer applies to styles found under Sale category online. Prices are as marked online. Offer is subject to availability and while stocks last. Due to the high volume of demand and if website difficulties are experienced, Stance cannot guarantee the availability of stock. Offer cannot be used in conjunction with other offers, redeemed against prior purchases and is not available on lay-by. Offer is not available on the purchase of gift cards/eVouchers. Promotion may be extended or changed at Stances' discretion.

We work hard to ensure the Website is always up and available, but we can’t guarantee that the Website will not have downtime for any reason. We reserve the right to close the Website for short periods of time for regular updating of products and for general maintenance, but will attempt to keep this to a minimum. We will not be liable if for any reason all or any part of the Website is unavailable at any time, for any length of time.

Parts of the Website require you to input a password to access certain features. This is to be able to give you details relevant to your order whilst still keeping them private to you. To do this, as part of our security procedures, we require you to register an account with Stance by entering your email and choosing a secure password. We highly recommend that you choose a strong password that is hard for others to guess, and you log out from your account at the end of every session. There is a password reset procedure in case you forget your password. You must treat your account log-in information as confidential, not disclosing it to any third party and only using Stance in person. If you think there may have been any breach of security then it is your responsibility to notify us immediately and if log-in is possible, to change your password.

It is a condition of your use of the Website that all the information you provide on the Website is correct, current and complete. We reserve the right to disable any user account in our sole discretion, at any time for any or no reason, including if, in our opinion, you have failed to comply with any provision of these Terms of Service.

SSL encrypted browsing is available for all logged-in users, but while we strive for this, we cannot guarantee that all use will be secure. While we work hard towards this, we also do not guarantee that the Website or any content provided on the Website is error free. We manage your personal data according to our Privacy Policy.

We take great care when putting product information, descriptions and images on-line but will not be held responsible for any mistakes or omissions to any information given.

The prices indicated on Stance Australia are shown in Australian Dollars and include all local taxes but do not include delivery, inbound duties or local delivery taxes. Theses delivery costs are clearly shown and invoiced at the end of the order in addition to the price of the products. We reserve the right to modify our prices at any moment but this will be indicated to you on the order at the time the order is placed. If an obviously incorrect price appears on our website and is not corrected on your total at the time of order completion, for whatever reason (human error, technical error etc.), your order will be cancelled and the payment refunded to you, even if it has been initially validated.

We will always endeavour to fulfil your order once completed and paid for. If a product should become unavailable after your order has been confirmed and paid for, we will refund the price you paid for the product immediately. If your order includes products that are temporarily unavailable, we will send the available products out first and will follow with the outstanding items once they are available again. We will refund the shipping fees for the rest of the order. If relevant, we will offer you a replacement for an unavailable product, a product of equal price and quality. If you accept the replacement, and then wish to return it to us in the conditions outlined under Returns, the return postage will be covered by us. If you choose to decline this offer, and the original product is permanently unavailable, we will reimburse the price of the unavailable product.
